Pepeʻekeo Man Indicted in Child Pornography Case

A Pepeʻekeo man initially charged with child pornography offenses in Kona District Court was indicted.

The indictment against 20-year-old Elgin Marcos was filed in 3rd Circuit Court on March 15. Charges stem from an incident on Nov. 21, 2021, involving a minor. Offenses include three counts of first-degree promotion of child abuse, second-degree promotion of child abuse and first-degree violation of privacy.

Marcos was originally arrested and charged via Complaint in Kona District Court on March 8. At his initial appearance, Marcos’ bail was reduced over the prosecutors’ objections and he later posted $10,000 bail.

According to the indictment, Marcos allegedly produced or participated in the preparation of child pornography as well as its dissemination. According to the indictment, Marcos threatened to disclose an image and/or video of another person in the nude and/or engaging in sexual conduct, “without the person’s consent with intent to harm the person’s health, safety, business, calling, career, education, financial condition, reputation, personal relationships, and/or as an act of revenge and/or retribution.”

The most serious offense, first-degree promotion of child abuse, is a class A felony offense and carries a maximum penalty of 20 years in prison.

Prosecutors elected to proceed via grand jury indictment in the case and secured the issuance of the $50,000 bench warrant. Marcos is scheduled to make his initial appearance on Monday in Kona Circuit Court. He remains in custody.
